Please read the Terms of Use carefully before you start using NEAR. Your use of NEAR constitutes your acknowledgment that you have read and understood these Terms, and your full and unconditional agreement to be bound by them.
NEAR is a digital platform that aims to connect freelancers, project owners, and companies within a professional environment that allows the provision of services, project implementation, and professional cooperation in an organized and safe manner.
By using the platform in any way, you acknowledge that you have read and understood this policy, and agree to fully comply with it and all subsequent updates. If you do not agree to any of its terms, you must stop using the platform immediately.
To use the Platform, you must be of legal contracting age in your country of residence, and have full legal capacity to enter into binding agreements.
All users are committed to the following:
• Use the platform for professional and legal purposes only.
• Compliance with all applicable regulations and laws.
• Commitment to ethical and professional standards in dealing with other users.
• Do not misuse the platform, harm it, or disrupt its services.
• The user must be legally qualified to create an account on the platform.
• The user is obligated to provide true, accurate and up-to-date data, and to update it when any change occurs.
• The user bears full responsibility for the confidentiality of his account login data.
• The user is responsible for all activities that occur through his account.
• Any unauthorized use of the account must be reported immediately.
• The platform has the right to suspend, stop, or terminate any account that violates this policy, with notification to the user where possible.
Users within the platform are obligated to:
• Providing correct and accurate information in all transactions.
• Respect the rights of other users and not abuse or manipulate them.
• Refrain from fraud, misleading or impersonation.
• Do not publish or circulate any illegal, offensive, harmful, inflammatory or discriminatory content.
• Adhere to professional conduct and avoid bullying, harassment or hate speech.
All users are committed to the highest standards of honesty, integrity and transparency in all transactions within the platform.
This includes in particular:
• Carry out contractual obligations in good faith.
• Adherence to the agreed upon specifications and conditions without distortion or tampering.
• Refrain from any behavior that would harm the professional trust between the parties.
• Avoid any fraudulent, misleading or exploitative practices.
Any breach of the principle of honesty and integrity is considered a serious violation of this policy.
• All contracts between users take place directly through the platform.
• NEAR acts only as a technical intermediary enabling communication and contracting.
• The platform is not a party to any contractual relationship between users.
• The platform does not bear responsibility for the quality or results of the work or its implementation.
• Each party bears all its contractual responsibility towards the other party.
The following fees apply to use the platform:
First: commissions
• 20% commission on projects.
• 20% commission on services.
• 25% commission on digital products.
Second: Additional fees
• $2 for issuing an electronic contract for each contract.
• $3 to issue a non-disclosure agreement (NDA) for each project.
• $1 per day for advertising a project, service or product.
• $9.99 annually to upgrade the account to a premium account.
Deduction mechanism
• Fees and commissions are deducted from the user’s electronic wallet balance.
• The value of projects and services is deposited in a dedicated escrow wallet within the platform.
• Funds remain reserved until delivery is completed and approved by the customer.
• Dues are released according to the approval status within the platform.
• This system aims to protect the rights of all parties.
NEAR provides free use of the platform within the basic package, in addition to monthly subscription packages designated for freelancers.
Packages include the following:
The Free package is worth $0
Spark package worth $20 per month
Top package worth $39 per month
These packages may include additional features and services that are announced within the platform. NEAR may modify the content, features or prices of each package as it deems appropriate to develop the service.
• All payments must be made via approved payment systems within the platform only.
• Any circumvention or bypass of these systems is considered a serious violation.
• The platform has the right to suspend or terminate violating accounts immediately.
• The user bears full responsibility for the content he publishes.
• Intellectual property rights must be respected and the rights of others must not be violated.
• The platform has the right to review or delete any violating content without prior notice.
• The user retains ownership of his content while granting the platform a non-exclusive license to use it within the limits of operating the service.
NEAR is committed to protecting personal data in accordance with its approved privacy policy, which is an integral part of this policy.
By using the platform, the user agrees to the collection and processing of his data to the extent necessary to provide and improve the services in accordance with applicable systems.
Users are prohibited from:
• Creating fake, misleading or impersonating accounts.
• Use the platform for illegal or fraudulent purposes.
• Attempting to hack systems or gain unauthorized access.
• Using automated tools (bots) without permission.
• Damaging, disrupting, or misusing the platform in any way.
NEAR IS PROVIDED AS IS AND WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. NEAR does not bear any legal responsibility for any direct, indirect, consequential or other damages that may arise from the use of the platform, or from any disputes arising between users.
The user acknowledges that his use of the platform and communication with other users is at his full personal risk, and NEAR’s responsibility is limited to the role of technical intermediary in accordance with the terms of service and approved policies.
NEAR reserves the right to:
• Suspend, stop, or delete violating accounts.
• Terminate accounts that pose a threat to the platform or users.
• Take legal action when necessary.
• The user has the right to request the closure of his account while settling any existing obligations.
NEAR reserves the right to modify this policy at any time based on operational or legal requirements.
The updated version will be published within the platform with the effective date, and continued use after the update constitutes explicit acceptance of these modifications.
• This Policy shall be governed by and construed in accordance with applicable laws.
• If any clause conflicts with mandatory laws, the law shall apply only to that clause.
• Failure to exercise any right does not constitute a waiver thereof.
• Use of the platform constitutes full, unconditional acceptance of this policy.
